Our Terms (Contract) Of Work

Any time you sign up for any of our services, the payment gateways will always contain an acceptance box for these terms specifically. There will always be a direct link so you can read them in full before purchasing.

 

Terms & Conditions

1. Introduction

Welcome to Firston Media, I’m so happy that you’ve decided to work with us. This document will set out the basic terms & conditions related to the payments, what is covered as part of your membership with us and how to use the services that are offered. If you agree to the services, when you complete the sign up process on the website you will be asked to tick a box saying that you agree with the terms & conditions, this is the legal equivalent of your written signature on a contract and is equally binding. Only by click ‘Yes’ will you be able to finish signing up for the service.

2. Access & Service

Your access to the services depend on your continuous payment of the monthly fees, if the monthly fees are not maintained Firston Media reserves the right to stop your access to the services, this includes but is not limited to taking your website and associated platforms offline until such time that payments are resumed. You have the option to cancel at any time however upon cancellation you will lose access to all services and your online systems will be taken offline. We will keep all of your platforms in a secure vault for up to 6 months should you decide to resume your monthly payments.

3. The Services You Have Access To

As outlined on the Firston Media website, your monthly cost will include the cost incurred with the building of your website and platforms, the monthly hosting upkeep and maintenance of your site and any ongoing update, changes or additions to the website and related systems. Your log in on the Firston Media website will give you access to a ticket system which should be used to create tickets relating to updates as well as a calendar to book meetings with us should you need any support.

4. Fees & Payments

We will charge you a standard monthly fee for our services (or annual if stated as such), this is outlined on the website and will be presented during the sign up process. Your first payment will be taken at the point that you complete the sign up process with subsequent payments come out on, or as close to as possible the same date each month. Firston Media retains the right to make changes to our fees at any time for any reason, however, wherever possible we will give you one months notice before any changes take place. You can cancel any subscriptions you may have with us by using the ‘manage your account’ option at the top of our site, or by contacting us on brad@firstonmedia.com

5. What’s Covered By The Management & Updates?

Even when using a do it yourself website builder you will be responsible for making monthly payments that cover the cost associated with running the website and our fees are no different. Your monthly payment goes towards the costs that we incur in securely hosting the website and registering the domain as well as the time it takes us each month to run updates, monitor security and create regular back ups.

It also includes updates and support that you may need. We will take care of any cosmetic changes and update (with no upper limit) as well as adding new services or amending existing features. The only time that you may incur additional costs on top of your monthly payment is if you want to add a new feature to your website that is significantly outside of the scope of what the website already offers. We would of course discuss this with you in advance and work out a payment plan that suits you whether that’s a one off payment or adding a small amount to your monthly payments. One such example of this that has happened would be a client who offers in person services via a booking platform, who then decided to pivot the business to become an online, on demand video library instead. There was a cost incurred by us to make those changes however we will only ever make any of these fair changes in discussion and agreement with you.

6. Cancellations, Minimum Periods & What Happens

Our cancellation period varies depending on the product or service that you are signing up for, we will always make it clear to you before you purchase what that is but it will usually be between 3 and 12 months. After that initial period, you will automatically revert to a simple monthly rolling term. If you cancel, your website will be taken offline and placed into ‘cold storage’ for 90 days, if during this period you change your mind, we can reinstate your website and systems immediately. After 90 days it will be deleted and is not recoverable. When cancelling you will lose your website as well as all related business systems including payment gateways, booking platforms, members areas and any other built in features.

If you feel you aren’t getting enough benefit from the monthly management service, after 12 months (this means the time it takes us to initially build the systems is covered) you can reduce your payments to £50 per month. This then covers the hosting, security, domain and maintenance of your website and associated systems however any updates will be charged at our hourly rate instead of being included.

7. Privacy Considerations

Your details will never be shared with a third party and are used solely by Firston Media. This includes your payment details that are stored securely by our payment partner Stripe. You will have access to all historic invoices and should you cancel the service have the right to request that any and all personal information be removed from our systems.

8. Refunds & Terms On Product Purchases That Are Not Subscriptions

We do not offer any refunds for any circumstances including if the product is either discontinued or loses functionally either due to a change we make, or a change that any of our third party suppliers may make. In the event of that happening we will do everything we can to resolve and issues you might face. Refunds are not offered and it is your responsibility to read the terms & conditions prior to purchase.

9. Ownership

Who has copyright ownership of your product depends on what you have purchased and how you have purchased it, we will outline them below. 

  1. For logos and branding, once payment is made you will be the full owner of the designs, we retain no ownership over them whatsoever. We will still retain the files and may use them for marketing and self promotion purposes.
  2. For websites or landing pages, if you make payment in full then once the work is complete, you retain full ownership over the works. By default they are always hosted with us which you will be invoiced for accordingly, however it is within your right to source your own hosting and migrate your works over if you want to as the owner.
  3. For websites or landing pages if you pay monthly, we retain the ownership of the works in full. For as long as you continue to make the agreed payments your works will stay live. If you decide to cancel, then everything will go offline and as you do not have ownership rights, you do not have the right to retain the works and migrate them to another service. If you cancel your monthly plan and do want to retain the works, you can pay a one off fee of £499 for everything to be migrated to a host of your choosing and for full ownership to be handed over to you. This means you will then have full ownership of the works totally independent of us.

10. Acknowledgment

This agreement represents the understanding between you and us (Firston Media). If you agree to be bound by the terms of this agreement then simply tick the ‘yes’ box as part of the sign up process to signify that you agree.
